Nashville DUI Penalties
In Tennessee, a person can be convicted of a DUI if they are operating a motor vehicle on public roadways and contain one of the following:
- 1. Is under the influence of alcohol
- 2. Breath or blood alcohol content of .08 or higher
- 3. Under the influence of drugs or prescription drugs
- 4. Is under the influence of a combination of drugs and alcohol

First Dui Offense:
This can be one or a combination of the following:
- Fine: Ranging from a min. $350.00 – max $1,500.00
- Jail Time: mandatory consecutive 7 days if blood alcohol readings exceed .20%
- Driver’s license revoked for one year
Second Dui Offense:
This can be one or a combination of the following:
- Fine: Ranging from a min. $600.00 – max $3,500.00
- Jail Time: Ranging from 45 days minimum to 11 months and 29 days maximum
- Driver’s license revoked for two years
- Alcohol and drug treatment programs available as jail credit
- Forfeiture of vehicle if used in the offense
Third Dui Offense:
This can be one or a combination of the following:
- Fine: Ranging from a min. $1,100.00 – max $10,000.00
- Jail Time: Ranging from 120 days minimum to 11 months and 29 days maximum
- Driver’s license revoked for 3-10 years
- Alcohol and drug treatment programs available as jail credit
- Forfeiture of vehicle
Fourth DUI Offense:
This can be one or a combination of the following:
- Conviction of a Class E felony
- Fine: Ranging from a min. $3,000.00 – max $15,000.00
- Jail Time: Ranging from 150 days minimum to 6 years maximum
- Driver’s license revoked for 5 years
- Alcohol and drug treatment programs available as jail credit
- Forfeiture of vehicle
If you are placed on probation after serving your jail sentence, additional conditions of probation may be required; this may include community service, drug or alcohol rehabilitation program, and any other conditions of probation ordered by the Court.
